GDPR OVERVIEW

  • If you do any business with EU customers or see any EU visitors on your website, then you are exposed to EU customers directly and collect basic personal data on EU citizens.
  • This means they have a legal right to request that information from you. If you can’t produce or delete that info, they can report you for violating the law.
  • You need to update your privacy policy to address the law and keep your business safe from being penalised.
  • Even if you are not doing business with EU customers, you are still exposed to the EU GDPR Law, because EU consumers can still visit on your website.
  • You can try blocking the incoming EU web traffic to your website, if you do not do any business with EU customers. However, this measure is not enough and will only partially help your business.
  • Because consumers can access your website through their VPN (when in excursion, as an example), you are still exposed. 
  • Basically, when consumers visit your website, their data remain on the server.
  • Cutomers have have a legal right to request that information from you.
  • Even worse, if your website (and the server, obviously) is hacked, you have 72 hours to notify its clients and the EU Regulatory Body.
  • Either way, if you do not comply, you will be served a fine of up to 4% of your total turnover, or up to €20 million - whichever is greater.
  • If you do business directly, then you’ll need a few more compliance steps. You need to update your privacy policy, add cookies policy in place, set up the cookie consent on the website, manage consumer's requests (data deletion, right to forget, etc), and a bit more.

  • The new regulation started on May 25, 2018.
  • In The UK, GDPR will be enforced by The Information Commissioner's Office.
  • The government is responsible for ensuring that UK law complies with the requirements of GDPR.
  • Both personal data and sensitive personal data are covered by GDPR.
  • GDPR gives individuals a lot more power to access the information that's held about them.
  • There are more obligations for better data management for businesses, and a new regime of fines.
